The Flaming Lips Audio Recording and Transfer Policy
Recording
Audio or Video audience taping is not permitted at Flaming Lips
performances. Anyone found taping in violation of the above policy may
be removed from the venue and unauthorized recordings may be confiscated.
At the same token, the Flaming Lips' management does not care if live
recordings are traded among fans. The management prefers demos, promo
material and ESPECIALLY STUDIO RECORDINGS not to be traded. Any posts
asking for copies of studio albums will be deleted by the administrator and
may result in that person being permanently banned from using the message
board.
In addition, I
own a copy of a video from a show which the camera man approaches Wayen for a
"video signature"... Wayne didn't seem to appreciate it (and likely
let alone film the show). Please do not make unauthorized video
recordings.
Duplication
All participants in audio recording exchange (regardless of format)
acknowledge and respect the copyrights and exclusive ownership of the music
and performances by the performers, writers and publishers.
All taping must be for personal use only, which may include trading (via
analog or digital tape, CD, or digital file transfer). Recordings may be
traded only for an equivalent amount of similar media (cassettes or CDs,
pre-recorded or blank). Regardless of any expenses incurred, no money may ever
be exchanged as part of a trade; however, stamped, self-addressed envelopes
may be included with blank media. In addition, the media by which audio
trading is publicized may not be commercialized. Therefore newsletters, web
sites, clubs, or any other communication forum facilitating audio trading
cannot accept advertising, offer links for compensation, exploit databases
compiled from their traffic, or otherwise derive any commercial proceeds in
any form. Stores or businesses may not offer to duplicate Flaming Lips media
for customers or sell or otherwise provide media containing unreleased Flaming
Lips music for any price. A statement of compliance with this policy must be
clearly posted on all web sites engaged in trading activity.
If the Flaming Lips have chosen to offer for sale (via physical media such as
CD, or via digital transmission) a particular Flaming Lips performance, this
"official" version will take precedence over amateur recordings
being offered for download. In these instances, we require that digital audio
repositories remove any recording of these particular performances from their
collections within 3 days of the official release or 3 days of Flaming Lips
announcing the intention to release, which ever is earlier. Notwithstanding
the above, Flaming Lips reserves the right to require immediate removal of any
unreleased Flaming Lips material. It is the responsibility of the site host to
remain informed of the current list of the Flaming Lips' officially-released
recordings and to maintain their site accordingly. In no case may any
officially-released Flaming Lips recording (live or studio) be duplicated or
otherwise traded or offered. Broadcast of unreleased Flaming Lips recordings
via: radio or online is permissible only if it conforms to all the guidelines
applicable to other forms of duplication.
Unauthorized sale, duplication and/or distribution is strictly forbidden. All
Flaming Lips performances and recordings are the exclusive property of the
Flaming Lips. All rights reserved. The Flaming Lips reserve our sanction of
tape trading, and/or non-commercial digital audio file transfers on a case
specific basis or in general, as we deem necessary. No waiver of any copyright
or trademark right is intended.

In addition, others and myself will be ocassionally monitoring flaming
lips' auctions on Ebay.com. Any illigitimate, pirate, live or bootleg
recordings offered for sale will result in the seller being brought to the
attention of Ebay's Safe Harbor and Warner Brother Records (which will result
in the deletion of your membership). In addition, if you acquired these
recordings through trading at The Flaming Lips Trading Post, you will be
permanently banned from the message board.
This website is a non-profit website. The owner nor the people who
maintain this website and related websites do not profit in any way from this
site's operation. All photos are the copyright of The Flaming Lips or
the respective photographers. All photos are used with
permission.
Others and myself will be policing for illegal (attempted) sales of
bootlegs. We focus upon auction sites (such as Ebay) and websites.
Anyone selling bootleg recordings (violation of copyright law) will be brought
to the attention of the RIAA.
